GIFTOPIA – TERMS AND CONDITIONS
GENERAL
- You are agreeing to Giftopia’s
terms and conditions when you access, browse or use
this website.
- When you purchase an item displayed
on the Giftopia website, you agree to be bound by
these Terms and Conditions.
- From time to time Giftopia may
need to amend these Terms and Conditions and any amendments
become effective immediately.
- All goods remain the property
of Giftopia until paid in full.
- The customer or recipient cannot
hold Giftopia liable for any incidences that may occur
(eg, damage, illness, or injuries) from any of the
products that maybe consumed or used from one of our
gifts or floral arrangements. It is the responsibility
of the customer/recipient to make sure that the products
meet the individuals requirements and are not harmful
to the individual to consume or use.
- Giftopia offers the service
of a free membership, with many benefits to our customers
when they purchase items from Giftopia’s online store.
Once you register to become a Giftopia member, it
is the responsibility of the member to maintain and
update all information required for easy processing
of orders and correspondence. You agree to take responsibility
for all transactions and any other activity that occur
within your membership account. You agree to maintain
and keep all membership details including your membership
login and membership password confidential and secure
at all times.
PRICING & ORDER PLACING
- All prices are AUS dollars and
include GST, Handling Fee and Delivery Fee – No more
to pay. These fees also include a Credit Card clearing
fee of 2.5% to cover the cost of offering a credit
card service.
- Products and images found on
this site are used as guides only and sometimes due
to an item being unavailable or out of season, it
may cause the final product to be slightly different
from the image illustrated. Giftopia reserves the
right to make the decision to substitute the unavailable
item with a similar item to equal or greater value.
- The images and designs pictured
on this website indicate the ‘Classic’ size/value
and the price is representative of the product illustrated.
The ‘Standard’ price (if selected) indicates a decrease
in the size of the flower and container value. The
‘Premium’ indicates a larger increase in size of the
flower and container value.
- Once you have placed your order
with Giftopia’s online store, you will receive an
email confirmation and receipt. If you do not receive
this email confirmation/receipt, this means your order
has not been received or processed and you need to
contact Giftopia immediately.
- Giftopia must receive your
payment in full prior to supplying your beautiful
gift.
- It is very important to make
sure you have supplied Giftopia with the correct delivery
address and any additional information that may assist
us in the prompt delivery of your order. Unfortunately,
Giftopia will not refund monies for incorrect information
or delivery details.
- Please read the contents description
carefully. Props such as, glasses, platters etc are
not included, unless specified in the detailed contents
listing.
CANCELLATIONS, REPLACEMENTS, REFUNDS
CANCELLATIONS
Giftopia cannot cancel any
order that has already been made up, even if the order
has not been delivered. If the cancellation request
is made before make up, then Giftopia may be able to
cancel the order. However, Giftopia cannot guarantee
that the order can be cancelled if particular stock
was ordered specifically for your order.
REPLACEMENTS
A complimentary guide on
‘How to care for your flowers’ and a sachet of flower
food is attached to every order of flowers that are
delivered. By following the instructions on the guide
and use of the flower food we are sure that you will
enjoy your flowers for much longer.
We guarantee the freshness and quality of our flowers
and that you will only receive the best every time you
purchase flowers arranged and supplied by Giftopia.
If you are not satisfied with the quality of your flowers
we are more than happy to replace them for you.
Flower Quality Replacement Guarantee
Quality complaints must
be received within 3 days of delivery. A photo is highly
recommended for quick resolution to quality complaints.
To honour our replacement guarantee, Our instructions
on how to care for your flowers and use of the flower
food must be met. Complaints received after this time
frame will be considered on an individual basis.
Refunds
Generally it is not Giftopia’s
policy to refund the price of a product. However, every
situation and customer is different, which may require
a decision on a case by case basis. Giftopia can aslo
provide alternative solutions such as resending the
order or giving a credit voucher for future use with
Giftopia. Please contact Giftopia, so we can determine
the right solution for you.
Non Delivery
Giftopia will do our absolute
best to deliver your order of flowers or gift, but we
do not guarantee the delivery of any product if one of
the following occurs
- Recipient refuses to accept
delivery of the gift
- Address provided is incorrect
- We are instructed to leave the
order in a safe place if no one is home (eg: porch,
balcony, front door) and the unfortunate event of
theft or damage occurs.
If one of these instances occurs,
we may judge that the delivery has been made.
Non delivery complaints must be received within 14 days
of the delivery date. Complaints received after this time
frame will be considered on an individual basis.
CANCELLATIONS, REPLACEMENTS, REFUNDS
WARNING: Under the Liquor
Act it is an offence to supply alcohol to a person under
the age of 18 years and for a person under the age of
18 years to receive or purchase liquor. Under the liquor
licencing act section 6(1)(I) of the Liquor Act, Giftopia
is exempt from the need to hold a liquor licence in
limited circumstances. These circumstances allow florists
and gift shops to sell gift baskets containing liquor
without the need to hold a liquor licence. However,
Liquor Act offences still apply where liquor is supplied
to minors. Maximum court penalties of $5,500 apply ($550
penalty notice) for this offence.
